This is because of physics, or Newton’s Second Law of Motion, where force = mass x acceleration. The heavier loaded semi-truck will impact the smaller vehicle with a greater force than another vehicle traveling at similar speeds. As a result, the smaller vehicle will also absorb substantially greater damage. The reason for this is simple: the heavier the striking vehicle is, the less it slows down as a result of an impact with another vehicle.  Think of a locomotive, which is slowed little or not at all by hitting an SUV.

The NHTSA reports that between 2016 and 2018, there were 14,534 deaths involving large commercial vehicles.

The Federal Motor Carrier Safety Administration has specifically limited the number of hours a commercial driver can work. Under this rule, commercial drivers can online work 11 cumulative hours behind the wheel within a 14-hour period. Following this work period, truck drivers will need to rest for a minimum of 10 consecutive hours. Those who are employed in daily operation will not be able to work over 70 hours in an eight day period. 

Legally, truck drivers and truck companies are required to keep a log of their working hours. After an accident, these logs can be subpoenaed and obtained by request in legal discovery. 

California’s Statute of Limitations for Truck Accidents
